I have been "on vacation" for about the last week, so I apologize for the delay, but as of today, there are no responses from either party about this matter. I can tell you that months ago, I exchanged cordial emails with both Bob and the party I proposed might be interested in taking over the site. Both seemed agreeable, but Bob did menton "if the problems with Amos/Scott can be ironed-out" (that may not be an exact verbatom quote, but that was the gist of it.) So I was quite optimistic that something would result from these initial exchanges between the three of us. Now I don't know what to think. But I'm not going to simply do nothing. I am going to go back to them and send a more forceful message and hope I can get one of them to shed some light on this. Optomistically, perhaps there are negotiations taking place. Pesimitically, they gave up. I note that the other major US informational website (The Swedish Tiger) has been acquired by the Classics Society, and yet no mention that I am aware of was ever made abut this possibility *before* it actually occured, so perhaps we are unreasonable to expect either party to want to "share" the current status of the USA/1847 situation. I'll be back.....

I aside from this basic discussion, the fact that this thread has now developed into a fantastic exchange on the broader subject of the Scott copyright, is excellent, and it has to be one of the most informative threads ever on the SCF!

If I were Scott...I would work a deal that would include free advertising for my publications on 1847usa web site.
To eliminate a popular research site, that perpetuates the use of your system, and thus further need of your product, seems penny wise and pound foolish.

The reason is because that kind of leniency provides a basis for usage claims by others. More than one copyright holder has learned to his/her dismay that vigilance against all comers is the price for keeping copyright.

A soft handed approach would answer the concerns essayk has laid out above and still allow a wonderful site to exist fairly unencumbered.

This is not fully correct. Copyright is not subject to the "policing" requirement that exists for trademarks, which is based on the theory that failure to enforce a trademark causes the mark to lose distinctiveness as identifying to consumers a single source of goods or services. Copyright does not have that issue. A copyright owner may, without prejudice, silently observe infringement for years without taking action, and then successfully sue for infringement. However, if the copyright owner places the infringer on actual notice that a claim exists, and then acquiesces in infringement or waits too long to sue, then equitable principles of estoppel or laches (excessive delay) or acquiescence may bar relief in the delayed lawsuit. Usually it takes more than 5 years of delay for a court to find that you "sat on your rights."

I wish to immediately correct a mistake I made in earlier posts. I have been informed by the President (John Barwis) of the USPCC that in fact, they have NOT acquired "The Swedish Tiger". I apologize for that error. I swear I thought I saw it in print from a reliable source! Obviously not! Again, I apologize.

Amos must have known for years, about 1847usa. Why are they just getting around to this now?

Bill - I also saw this written down somewhere that there was a plan for the USPCS to take over the Swedish Tiger website. It appears it never came to fruition.

smaugee;

Thank you! I'm pleased that I wasn't imagining the whole thing. But wouldn't you think that if this was the case that President Barwis would have noted that? Let me check this wih him. I'll be back.....

I found this conversation, it was apparently mentioned on facebook:

From: Ken Lawrence (Teamcat) Dec-12 2:03 PM
To: swedishtige1 (9 of 13)
51018.9 in reply to 51018.7
A note on your website says it would cease to exist at the end of 2012 with contents transferred to the Classics Society website.

Thank you. It's actually an old posting from FB, I went into FB to delete the reference. To complete the story, I, built the new USPCS site using pretty much the same information as on the SwedishTiger site, although not quite to the same depth. After doing this I saw that there was less of a need, plus 2014 has been a crazy busy work year for me. Any feedback as if I should keep the pricing going or not?

Fantastic topic! Thank you to all who participated - I learned a great deal.

When I tried to sort out the banknote issues, Scott's specialized US catalog was insufficient for the task, or maybe I just could not figure out how to interpret it. The 1847 site enabled me to solve the problem

This is the only post I wish to address.

If there's one thing I've learned over the years, it is that the Scott Specialized Catalogue of US Stamps and Covers covers the broadest range of any catalogue on the market and therefore is one of the first resources a collector should purchase. However, if Scott were to cover every detail of every stamp issued by the POD/USPS, the size of that catalogue would exceed anything I could imagine. My 4' wide bookcase contains two shelves completely full of publications covering US stamps and I am a long ways from owning everything!

If you are looking for more info on the US Banknote issues, start with Lester Brookman's books "The United States Postage Stamps of the 19th Century"

They can be downloaded for free from the United States Philatelic Classics Society website here: http://www.uspcs.org/resource-cente...nic-library/

Couple of things;

1. Aside from the resource Brian mentions n his post, there is a (hopefully!) good amount of info and a free matrix on my website (www.stampexpertizing.com). Check in the "Articles" area.

2. The same postings on the old VSC quoted by raymodj were located and sent to me by USPCS President John Barwis who kindly devoted quite a bit of time figuring out where the rumor came from about the USPCS taking over the Swedish Tiger and that exchange could very well be the genesis of the rumor. So now we know for sure that the USPCS does not "own" the ST site. According to John, the owner (Roger Kirby) did NOT "build the USPCS website" as he claimed in that post but rather simply helped with some of the initial designing.

Thanks for the "WAYBACK" MAchine Info. As for SCOTT vs. 1847usa, there is no copyright infringement here -- there are no prices listed, and informational copy (unless lifted without credit to SCOTT -- which it doesn't do) negates any claim held by SCOTT. SCOTT had better that it's lawyers and start suing EVERYONE -- every Dealer, EBAY, every Collector -- ANY using a SCOTT number in a description. Unfortunately, SCOTT has already failed to support its Copyright and 1847USA, if they were smart, would challenge SCOTT. Otherwise we are all… including this users of the Forum… in serious trouble.
