The fact of the matter is that what Ryle does is textbook fraud. It is the very definition of fraud. ebay is aware of it and it makes them complicit. Buyer beware is a great sentiment however how far do you take it. There is consumer protection for just about everything but not for ebay philately? I find it amusing that ebay will come down on someone like a ton of bricks for advertising a cap gun without an orange tip but ignore blatant shill bidding and even worse verbatim copying of stamp listing text over multiple usernames and broad swaths of time. The photos he uses over and over have the same metadata. No, this is never a case of buyer beware. This is criminal fraud plain and simple. And ebay does nothing. God willing 60 Minutes will.

What action do you all expect from the 60 minutes show? APS, ASDA go after this? ebay taking more proactive action against some sellers? They have exposed many things but not usually much action - just look at current events.

I am not optimistic.

Just thought readers might be interested in the following report that landed on my desk today -

A large seizure of a Class A drug has been made from a luxury yacht in Southampton. Source: UK Border Agency.
Officials found 80kg of cocaine with a street value of up to £30m in the yacht on Monday.
The 90% pure drugs were so well hidden in the 110ft motor yacht, the Jenny, it took six days to find them.
They had originated in Jamaica and were en route to the Netherlands. Hampshire police have arrested four men, including the owner of the yacht, Philip Ryle from Halifax. They will appear before Southampton magistrates in 3 weeks.
Footage taken aboard the yacht shows officials discovering the extent of the haul.
Video released by Serious Organised Crime Agency (SOCA) /UK Border Agency (UKBA).

I don't even believe the original post. It's unverifiable and could well be a deliberate troll. Yet here I am answering. How about naming the 60 Minutes producer?

I find it very hard to believe that any aspect of the Cartel story has the national level of interest that 60 Minutes normally demands. Compared to their typical subjects, Ryle looks like a local drifter pinching smokes from the corner convenience store.

I'm now wondering if this is the same guy who scammed me out of $25 on ebay circa 2000-2003. He was touting an expose book he had supposedly written about the underside of U. S. philately and the ebay-displayed table of contents was written so well and was so juicy that I fell for it. He portrayed himself as the spiritual leader of a church (called himself the archbishop or something like that) in Salt Lake City (no, not the obvious and famous SLC church) who had been collecting for years and wrote the book about his experiences in dealing with all the players in U. S. stamp dealing. There was no book and ebay eventually NARUed him but refused my refund request because the $25 did not meet their "threshold" for fraud remuneration! Happy to say it was my only loss on ebay in 250 buying experiences; I never lost any money on a stamp purchase - just this "book". Another collector who also got taken by this scheme emailed me at that time to say he had filed a report with several agencies including the postal inspectors but got nowhere because the amount taken per person was so small. A few months later the "archbishop" got back on ebay with another ID and tried to sell the "updated and revised" edition of his non-existent book; he was eventually NARUed again. Anyway, with the SLC connection, the way with words in the descriptions, the brazen repetition of fraud on ebay using different IDs - it makes me wonder if this wasn't the same person at an earlier stage of misdeeds. His ebay username was apostolicchurch circa 2000-2003 when I got scammed by him. Anybody know if there is a connection?

Conduct: Between 07 July 2013 and 05 July 2014 Mr Ryle caused Rare Stamp Associates Limited ("Rare Stamp") to trade to the detriment of HM Revenue and Customs ("HMRC") and to his own benefit by withdrawing monies for his own benefit amounting to £876,991. The funds were withdrawn without due regard to the interests of HMRC, as insufficient funds were left available to meet existing liabilities that were overdue in respect of Value Added Tax ("VAT") and Pay as You Earn income tax and National Insurance Contributions ("PAYE/NIC") or to meet further liabilities as they fell due. At liquidation HMRC was owed £491,084 including interest and charges:

- In respect of the liability for VAT, the oldest element of the debt relates to the period ended 31 May 2013 in the sum of £5,283 which should have been paid by 07 July 2013 and which remained outstanding as at the date of liquidation;

- On 17 January 2014 HMRC issued a Notice of Assessment of Tax and Surcharge Liability to Rare Stamp in the sum of £103,572 resulting from Rare Stamp's failure to submit a return or make a payment of the liability for VAT for the period ended 30 November 2013;

- On 10 March 2014 HMRC issued a letter to Rare Stamp warning of winding up action in respect of unpaid tax liabilities of £215,570. Rare Stamp made no payment to HMRC in response to the letter from HMRC;

- On 06 May 2014 HMRC presented a Winding-up petition against Rare Stamp in the sum of £215,585, in respect of unpaid VAT and PAYE/NIC;

- On 18 July 2014 HMRC rejected a proposal for a Company Voluntary Arrangement by Rare Stamp.
Meanwhile in the period from 7 July 2013 to 5 July 2014 he drew funds from the bank account held in the name of Rare Stamp for his own use totalling £876,991;

Between 07 July 2013 and 03 June 2014 Rare Stamp expended £1,094,981 of which £876,991 was paid to him, £200,326 to trade creditors, £14,861 to a connected company, £1,284 in expenses and £72 in bank charges. A further £1,447 was paid to HMRC which was allocated against the VAT liability for the period ended 31 May 2013.

Rare Stamp entered liquidation on 05 August 2014. The total amount outstanding to all creditors at liquidation was £1,302,056 of which HMRC were owed £491,083, including £489,361 in respect of unpaid VAT (including charges) and £1,722 in respect of unpaid PAYE/NIC (including interest and charges). He was the only other creditor, in respect of a sum which is disputed as there are no books or records which evidence his claim.

Stamps are hardly the only thing that suffers from fakes and fraud. The story isn't about gullible stamp collectors, it is about a man accused of repeated fraud and how ebay has (or hasn't) handled it.

Hopefully ebay will finally take note of this crook. I've noticed that there's always the complaint of how he's ripping off people(which is terrible); but no one ever seems to mention that his shady listing practices also effect other sellers listings. Say I'm selling a #16 Type IV in NR auction & he keeps listing the same #16 over & over again, at the same time I'm selling one, it's going to negatively effect what my listing sells for(because some buyers unfortunately still think they actually have a chance of winning their stamps/lots).

He doesn't live in Halifax, that will just be a front man address he's renting or using. This will not stop him, he's been struck off or gone bankrupt many times but still continues. It's a game to him..

It seems only purposeful, consistent legal action by ebay against Ryle and his ilk will have a good result, and that is not a high priority for ebay.

The challenges that jmt406 describes is one of several reasons why I list BIN for almost everything. Then every 60 days or so, I reduce my prices by 10% similar to a reverse auction system.
