I haven't seen any such option. Anyway I'm in a high tax rate zone, so I'd probably end up using the buyers county anyhow.

ebay apparently has added a system to submit documentation of exempt status, which should be useful for nonprofits and for resellers. We'll see how it works.

Also, many more states will be coming under the "marketplace" status. Right now ebay collects for MN, WA, IA, and CT. ebay's announcement indicates that NJ will be added May 1, Alabama, Pennsylvania, South Dakota and Oklahoma July 1, and South Carolina on October 1.

Ironic that South Dakota, which started this mess with the 200 transaction requirement, is now jumping on the marketplace bandwagon. I have to think that there will be more litigation over this.

Congress could address the physical presence issue tomorrow but Congress no longer functions. Sad.

Well, you know that the opposite of pro is con. So, the opposite of progress is congress. Given the gridlock in DC, I think they knew this when they named the house.

California appears to have reversed course and moved their threshold to $500,000. Which in the end is a win, except now I've spent hours getting registered, revising all of my listings to include tax, revising all of my descriptions to address tax issues, and changing my record keeping to track tax. And now I'll have to spend hours changing it back again once I see enough analysis to confirm that I'm reading the modification correctly. A real shame the legislature couldn't have figured this out BEFORE letting it take effect.

Fortunately, the new PayPal paradigm of refusing to refund transaction fees won't kick in until May 7th. Will PayPal impose the new refund policy on transactions paid before May 7th?

I've confirmed that the change in CA has eliminated the # of transaction test and now just has a fairly high threshold. On the other hand, CA has also added a "marketplace" piece to its tax structure, effective October 1 - so ebay will start collecting and remitting CA tax on all sales then.
