If you read the complaint in the first post it explains how the copyright office accepted a registration on the replica statue based on some subtle differences from the original. I think he probably has a case. Question is what are the damages.

He might have a case but I put this in the category of a frivolous law suit. The post office has no money for this kind of nonsense.

Don't forget...

Quote:
In September, the sculptor responsible for the design of the Korean War Memorial was awarded $685,000 in damages after the USPS used a photo of the memorial on a stamp without the permission of the copyright holder. In that case, a federal court found that the copyright holder was entitled to a ten percent royalty on sales of stamps to collectors, and on sales of merchandise featuring the stamp design.

And in the case of the Korean War Memorial, the USPS issued perhaps tens of millions stamps as a "commemorative"; the Lady Liberty stamp, however, was a definitive that was issued in the billions (with a "b")...if a court rules the copyright owner is entitled to a 10% royalty on that number ... $$$$ are at stake!

I realize you gave me and others a reality check. I just wish the man would go away and leave the post office alone.

The "problem" is our country decided that people who create things have a exclusive right to their use.

Here is a man pursuing that right. It's the American way.

The USPS made a big mistake and now they will have to deal with the consequences. I find myself wondering how far back was someone at the USPS aware that it was not a picture of the real statue of liberty that was being used.

This is probably the picture you're looking for, with the Vegas Statue on the left (as shown on the stamp) and the original New York Statue of Liberty on the right:

The illustration was taken from this subsequent news article which may also be of interest:
