My Scott 2004 lists Danzig 238-240 1939 Achievements issue Mint 1.80 and mint never hinged 4.75... My question is, the hinge mark is on the selvedge... does this qualify as mint never hinged

I'd say what you have is MNH.

If I was selling it, I'd still mention the hinge marks for completeness.

Yes, The Stamp IS MNH, the selvage is not. If you removed the selvage(please don't) it would still be a MNH Stamp. But, if selling it I would also disclose the hinge mark on the selvage.
