You may wish to check Colorado Unfair Trade Practices Act Section 6-1-101, et al. and for "Tie-in Sales" or other undisclosed advertised product or service. In any event, you ARE protected under U.S. Federal Law and under interstate commerce transmission of merchandise through the U.S. mails. Follow the FTC guidelines outlined - EXACTLY. ALL COMPANIES that operate by mail - Stamp Companies included - must adhere to the law. ( by the way, New York State law is one of the harshest on NEGATIVE OPTION PLANS). Notify the offending company they are in violation of FTC Regulations and send them a copy of the Regs!

Check your States specifically for 'SHIPMENT OF UNORDERED MERCHANDISE" statutes under "Unfair Trade Practices" sections. The LAW and Direct Marketing for Mailorder Companies is well spelled out. There is no excuse for a company selling stamps by mail to circumvent Federal or State Law. Check with your local State Attorney General - file a complaint online. You may be entitled to keep the merchandise without paying for it. Stamp Companies need to operate "Negative Option Plans" legally.

Kenmore sends a return envelope but no postage. They're not supposed to send stamps unless you fill out a section on the order form approving it. Supposedly

Blackhoreson, Supposedly is the operative word there. I still have an outstanding "debt" to Kenmore for sending me an unsolicited approval package after buying some stuff. It got lost in the mail or perhaps never got sent to me? Either way, four or so years later I'm still getting a bill from collections stating I owe just over $50 for approvals I didn't order, never got and had no idea was part of me buying collecting supplies.

A while after that Mystic send a totally different approval set to me that I didn't order on top of the approvals I did. I got an approval twice a week for over two months, sent all of them back and FINALLY got through to an operator to stop the shipments. They still tried to charge me for each shipment even tho the operator I called after getting the bill said that they'd all been recieved. I'm still getting reminders and threats for collection agencies even tho I keep getting told to ignore them.

I called when I sent my order out and said no approvals, left the section for them blank like it said for no approvals, and even e-mailed them no approvals. Hope like Hades I don't get any.

BettyAnn: May I suggest you send a Registered Letter with Return Receipt Request to KENMORE stating the following: "Please furnish "PROOF OF DELIVERY" of a shipment of goods from your company or record-of-receipt of unordered merchandise. Further, future correspondence from your firm will be considered "harassment" and a formal complaint will be filed with the ATTORNEY GENERAL OF THE STATE OF NEW HAMPSHIRE and the ATTORNEY GENERAL OF THE STATE OF (insert your state here.)" That should stop KENMORE's nonsense. Make a copy of the letter you send for use if you want to file a complaint or if you need to clear a "Collection Filing" reported on your Credit Report.
