Pascoe - ebay "accepting" anything on the seller's end means nothing. How he handles the situation is his problem. You received a damaged shipping package with a missing stamp. End of story. He needs to refund your money. His claim is with the USPS so I am confused what the ebay storyline is about. Smells a bit like manure IMHO. Why would he need to wait until the 22nd to file for a lost-in-mail item? I would file a claim right away but would let him know first in the interest of being fair. (more than fair) |

Ok, here's the next reply from the seller: Quote:If you wish to open a case do so. I have always been honest and above board. I don't know if you ripped open the package and wrote damaged on it and want to await the findings of ebay. If you do not wish to wait then go ahead and open a case. I am not accusing the seller of being dishonest and I am definitely being honest in reporting what was received by me. I did not ripped the envelope open, take out the 292, leave in the 293, then reseal with clear packaging tape, and hand write "rec'd unsealed". Should I move forward with opening the case on ebay? Should I submit something through PayPal? Is this the ebay claim workflow: - Go to the item - Select More Options - Do I select Request to Cancel, Report the item hasn't arrived, or Return the item? What do you all suggest I do regarding leaving feedback for this item/exchange? Thanks! |

The seller keeps referring to ebay's "findings". What are they supposed to find? They are not the CIA. LOL The stamp did not arrive and now the seller is planting a seed that perhaps you are the one being dishonest. I will leave the claim process to others to describe. I will say that as far as feedback goes I would not even get into that whole thing. Feedback is useless. Negative comments are removed all of the time and so you end up with a bunch of positive drivel that gives a false sense of security. Get your money back and move on my friend. |

I've done the "Report the item hasn't arrived" option. I selected I want a refund. Is this the same thing as what people are referring to as "opening a case"? I think so. The seller has until Feb 24 to reply and then ebay can step in. |

Hey Pascoe The vendors last reply insinuates you might be a thief. The only thing I have worth fighting over is my character, reputation. You are doing the right thing. |

Selecting any of the formal complaint paths with ebay essentially "opens a case". The problem I see with selecting the "not arrived" option is that the USPS tracking proves a package *did* arrive, which might not go in your favor if ebay has to arbitrate. A better choice would have been selecting a reason along the lines of "item not as described" or "item damaged" which admits something did arrive and opens the door more easily for a partial refund since you did receive one of the two items which should have been in the shipment - and makes it easier for ebay to side with you. |

do whatever you need to do to protect your rights. you paid for an item and did not receive it. I also would like to know the seller. I dont buy stuff like this on ebay yet, but id like to mark the seller so I can stay away when the times comes. I have sold some expensive cars on ebay and HAVE gotten the run around more than once after the sale by buyers not honoring their winning bids. so as we all know, bad actors out there. |

Looking at the first photo of the package. If this were damaged in handling within the postal service, the typical internal repairs would/should not have been done this way. Specifically I am not seeing some or all of the following: PO-marked tape, an extra postmark, a "damaged in handling" handstamp, initials accompanying the manuscript note. It is completely generic and anonymous. It does not "look right" even though the poster mentions that the tracking status mentions "visible damage".
Also, to be fair, now that the seller's ID has been posted, they should be invited to share their side of the story in this forum. |

I get taped up envelopes and packages from USPS just like the OP posted. Not long ago I received a rigid mailer that had most of the end torn off and stamps missing. There was no effort made to seal it let alone mark it according to the regulations. Those days are pretty much gone. The USPS can barely get the mail to it's destination let alone stamp it and use special tape and log it and rotate it and...…….

I agree rodgcam, this was a typical high-speed mail sorter jam. The days of sealing it, marking it, or putting it in a "body bag" are no more. These letter-jams are like a multi-car-truck pileup on the freeway. Many letters crash into the jam before the transport motors shutoff. The wedge can be so hard, the only way to free it up is to grab and rip out letters in pieces. Contents can spill out anywhere. Sending anything at the machinable rate, you have to realize you are taking this risk with every letter. No matter how much you seal up your letter, the letter just ahead of yours could be the dainty, thin, tissue-envelope with a Hershey candy bar inside. You are doomed!

Ditto Rogdcam The postal folk don't have the time to follow the regs. They have to move mail. |
