The stamps represented the payment of a tax. Under the Revenue Act of 1862 (enacted to help pay for the Civil War), photographs were one of numerous proprietary articles that were subject to the tax. Many documents, such as deeds, bank checks, and even marriage certificates, were also taxed.

To be hyper-technical, photographs were not taxed under the act of 1862, but were an addition to the list of taxed proprietary articles effective August 1, 1864.
