ebay has already said that you will NOT be allowed to do this. You cannot opt out of selling to certain states.

Correct. With respect to domestic U.S. addresses, you are only allowed to exclude the following:

Alaska/Hawaii (one setting for both states; you cannot exclude one but not the other)
US Protectorates (Guam, Virgin Islands, etc.)
APO/FPO
PO Boxes

There are no state-specific exclusion settings. If you try to sneak it through in your listing description, you're likely to get your hand slapped (or worse).

Not only that, prospective buyers will think you're batsh*t crazy.

What a mess. I know Indiana has made Amazon cough up sales tax on out of state sales in Indiana but have not seen any general enforcement efforts on inter net sales, yet.

I pity these two Kentucky boys. They bought water melons for a dollar, loaded them in their truck, hauled them to Indianapolis; then, sole them for $1.00. They had a Steak-N-Shake meal, bought a tank of gas for the truck, and drove back to Kentucky happy - until they realized they had less money that they started out with - not to mention any profit. There solution was next time use a bigger truck.

Folks, the bureaucratic costs of administrating a tax creates a threshold below which minting the next few pennies cost seven cents each. Exempting small sellers below a certain annual dollar amount only acerbates enforcement problems.

As my grandfather taught me, "You may not be able to do anything to make it better; but, you sure can make things worse if you are not careful".

Yep, "common cents" sure does not buy much anymore.

As an ebay Main Street Member, you are probably well aware of the June US Supreme Court ruling on Internet sales tax that overturned the long-standing physical presence sales tax collection standard. Since the Supreme Court ruling, ebay has been pushing hard for a federal solution that provides a common-sense solution that protects small, Internet-enabled businesses. ebay seller and Small Business Ambassador Network member Chad White testified before Congress in support of these efforts.


Last Friday, federal legislation was introduced that attempts to address the uncertainty caused by the Supreme Court ruling. Led by Representatives Jim Sensenbrenner, Anna Eshoo, Zoe Lofgren and Jeff Duncan, this bipartisan solution aims to provide a clear and sensible framework for collecting sales taxes from remote businesses that sell online and would exempt small businesses until such a framework is in place. At the same time, ebay announced that it had collected over a million signatures from Americans like you in support of such legislation. Click here to read more.


Additionally, ebay posted this announcement to the Community Board last week that may be of interest to you if you sell on ebay. As ebay continues to advocate for a federal solution, this post outlines how ebay will handle the collection of sales tax for sales into several states that now have sales tax collection laws in place.

During the opening remarks at the Kelliher auction today they announced that beginning in 2019 they will be collecting sales tax for residents of 19 states in addition to CT.
