 Were pot plants still legal in 1938 or was this cover offering potted plants? Another time warp word meaning change?

The answer is no, however. The Marihuana Tax Act of 1937 made marihuana a controlled substance. Along with the Harrison act of 1914 it helped create a large number of revenue stamps which ultimately enhanced the treasury by many hundreds of millions in tax money over the years. The narcotic strips listed in Scott are only the tip of the iceberg of drug revenue stamps, there are about 2 dozen special tax stamps as well which were taxes on the controls themselves (the licenses of people legally allowed to have narcotics). |

If that didn't sink in- look at this- someone arrested with a pound of pot has a choice. Go to jail for up to 2 years with a court fine of up to $10-thousand -- or pay a $15-hundred tax bill and walk free.
So far- Moran's client is the only known offender released under the 1996 ruling -- but the door apparently is open for anyone. According to Moran the process to transform the marijuana tax stamp into a get out of jail card first requires getting someone to go to the Comptroller's office and pay the tax.
"Get a receipt, attach it to an application for a writ of Habeas Corpus for violation of the Double Jeopardy Clause and you can litigate, the Supreme court says you can litigate that pretrial. Post a bond and you can just walk out the door..." At least stamp collectors can acquire the stamps (if they want them). Considering they depict the image of death, I wonder just how many would, though. |

You can thank Harry J. Anslinger for that. He had no interest in the illegalization of marijuana other than to advance his position in politics. You could get a tax stamp to legally sell your wares but you had to show up with it in hand to get the stamp. There are several states with a wide range of drug tax stamps. The Texas stamp is very popular with collectors. Search marihuana in ebay and you will find several from a variety of states, all of which are incredibly overpriced. |

The Scott listed federal marihuana stamps are not cheap, they all came out of the Smithsonian sales and there are not all that many sets around. I was talking about the state revenues, almost all of which are MUCH more common then the $30-$70 price tags most of them seem to have at the moment. |

Alas, no. I have a number of special tax stamps for various user types. When it comes to stamps my eyes are often bigger than my wallet. :-( |
