In all fairness, the fault in this case lies squarely with the buyer:

1. He conducted the purchase outside of ebay (he contacted the email address shown in an image rather than clicking to buy on the ebay page), which removes all protection/recourse, and IMO removes ebay's liability as engaging in such transactions is technically against ebay's terms and conditions that buyers and sellers agree to.

2. He used a payment method (bank transfer) that has zero protection.

Makes for an attention-grabbing headline, but nope sorry can't blame ebay 100% for this one.

... that enforces draconian requirements upon sellers and their business practices. I'm still waiting for someone with deep pockets to challenge the above assertion in a court of law.

Agreed...for anyone who has wondered how ebay scammers are able to open bogus and/or multiple (50+) PayPal accounts should take note of this

ebay has been challenged in court for this on numerous occasions. I remember reading about them years ago. They won every time...

My recollection was that it was not even close - the existing laws are on their side...

I think it would require more than deep pockets, it would require a level of extreme commitment. Challenging the very core of ebay business model means they would go 'all in' on a legal case where their very existence would be threatened.
