Ron Leith will not accept a return for any lot that has 10 or more items in it. So when you bid on a string of MNH definitive sets, which almost all have 10 or more stamps in them, he takes no responsibility for the description even if most or all are previously hinged.

Likewise, he can (and will) take great latitude with his descriptions of lots with 10 or more items because he will never take them back no matter what.

This is a common term of sale for many auction houses. They hate getting stuff back, but despite what that says, some of the good ones will still take such a lot back if the mis-description is significant enough (of course you and they may disagree on what significant is).

And that's my point- there should be a desire to make things right when there is an obvious, consistent problem with multiple lots in the same auction. So my opinion in this particular instance is that the misrepresentation is purposeful. I mean, how many hinges and hinge marks can you miss???

To add to eyeonwall's comment, whether an auction house takes something back will also depend on one being a really good customer. Houses also don't want to lose a big spender to another house.

Last week a received a postal history auction 'catalog'. It was about 50 pages, printed front and back on a computer and then folded in half to form a booklet. It had the mailing address on the outside but the thing was stapled four times. Not the normal office staples mind you, but rather the big industrial staples. Normal staple remover had no effect so not to be deterred from seeing its contents, I went to my tool chest and got several pairs of needle nose pliers and other tools.

First staple came out with a significant amount of 'persuasion'. Second staple broke and I ended up having to pry each broken part out. Same with third staple. Now with about 10 minutes into this task, I started on the last staple. It too broke and as I tried to work out one of the pieces out I managed to cut myself on the other ragged piece of metal. Bleeding and frustrated I threw the damn catalog into the trash.
