Intent to defraud can be proven based on circumstantial evidence. If the seller in GMC89's example didn't market the stamps as counterfeit and sold as collectibles, a jury could infer the intent to defraud.
Sure, but that has nothing to do with them being listed. The comment was made that Scott was pulling an ebay, which for all their other problems, they did not.
In my opinion Scott is promoting a market for these illegal items. It is one thing to list them for educational purposes, but I see no other reason for assinging catalog values other than to promote collecting them.
And thanks for filling me in that handbags are not stamps. I am considering collecting handbags now. Don
I am sure you would not be alone in that area. And Scott is not promoting anything that people were not already collecting for decades. Counterfeit stamps (specifically created to defraud the PO or the govt) have always been collected and highly valued. It's only that now China is flooding the current market with absolutely fraudulent stamps created for a different purpose entirely.
One can buy a "complete" Fournier portfolio for handfuls of thousands. Over the decades, they've been available for much less, and that's to say nothing of what's available online. Or Amos could borrow one.
The point being, if fakes, forgeries and counterfeits are now in their wheelhouse, let's start down the road of consistency. I'm not saying let's list every Oneglia or Winter, but, Fournier is uniquely cataloged. Baby steps.
I'd have been happier if they added a note underneath the applicable listings, rather than issue numbers to these new counterfeits. Poor form.
