What possible scenario would allow the buyer to get a refund without returning the shipment? I suppose a seller might say, "go ahead and keep it," for a shipment worth a buck or two (minimal value transaction) because they are not keen on paying return shipping.
But, normally, you don't get a refund until you a) receive the shipment; b) formally declare what is wrong with it (or why you want to return it); and c) the seller receives the shipment back.
In cases of item damaged or item not as described, the seller always has to full refund and pay for return shipping (if return is desired), regardless of their stated terms.
In cases of "buyer's remorse," it is not so clear who will pay return shipping... The seller has different compromises/options they can use (partial refund, partial refund and keep item, denial of refund, replacement item offered, buyer pays return shipping, etc.). Sometimes it depends on the seller's terms in the listing.

ebay "help" section is quite detailed and covers just about every situation.
I'm kind of wondering what type of buyer would want a refund AND keep an item (unless that is what the seller offered). But, perhaps I am not reading your question correctly...
