With the top of the design missing is there any other way to id this stamp? I guess it must be a type 2 or 3 but without the top I guess I'm out of luck?

I would say a Type 3 based upon the left and right shells. It is the only one that fits the bill. I use Micarelli's book.

It is almost certainly a Type III but there is another way. You can plate the stamp!
